Just got the check for $3590 from Mercedes court case regarding BlueTec emission violation. 4 years extra warranty plus cash, nice.

I also have Mercedes Benz diesel and filed a claim in July,... have not received anything.... can you please tell me how long ago you filed ???

Recall work was done late March; claim filed early May. I have 90 days to deposit the check giving me good choice to do it this or next year.

It is not at all clear that such a settlement is taxable. So, it may not matter.

I got my notice after I traded my Sprinter in so just ignored it. I've often ignored class action suits when I participated in one years ago that returned me less than the stamp for which I sent the form in. I guess this one is my loss.

It sounds like a complicated question that will have the same answer for everyone who receives a settlement. It depends on the facts of the settlement and I wouldn't trust the typical tax expert to reliably sort that out.

If it is taxable income I doubt it matters when you deposit the check, you received the money when you received the check (or earlier).

If they send you a Form 1099-MISC for the settlement payment then it's likely taxable. If you don't get a Form 1099-MISC then who knows?

I went through a similar process with my Volkswagen diesel; never received a 1099, never asked to pay any taxes, never paid any taxes.

I am pretty sure that they accumulated all the claims and then processed them more-or-less all at once. I doubt that the submittal time means much.

I just had mine done a month or so ago, and I got my mailing the same time as everybody else.

Yep, just received our check as well!

Had the initial work done in late March, mailed the submission on April 6th and then was informed that we needed a second upgrade for the 2011 van. Didn't seem to matter, and we even filed an objection that was disallowed at the trial on July 12th. Happy to get it. Every $3,590 matters! LOL! Waiting to see if we get a 1099-(Misc). Thank God that Mercedes-Benz decided to take the loss in 2021. They could've waited until September 30, 2022.
